TechTrail DMC Pvt Ltd (hereinafter referred to as "TechTrail DMC Pvt Ltd", "we", "us", or "our") operates a B2B technology platform (the "Platform" or "Website") that enables registered travel agents, tour operators, consolidators, and affiliates ("Agents" or "you") to access, search, quote, book, and manage individual travel services and components sourced from third-party suppliers worldwide. These include, but are not limited to, flights, accommodation, airport transfers, ground transportation, sightseeing excursions, guides, visa assistance coordination, and other ancillary travel elements.
The Information, data, rates, availability, and materials ("Information") on this Website/Platform are provided solely for informational and facilitation purposes. We make reasonable commercial efforts to keep the Information accurate, current, and reliable. However, we do not guarantee completeness, accuracy, timeliness, or error-free nature of any Information. Agents must independently verify all details before proceeding with any booking, quotation to end customers, or confirmation.
1. Use of the Platform
You warrant and represent that:
- You are a duly registered and licensed travel agent/tour operator in your jurisdiction (where applicable) and at least 18 years of age with full legal capacity to enter into these Terms.
- You possess all necessary licenses, registrations, and approvals required under Indian law or your local law to sell travel services to end customers.
- If you use the Platform or make bookings/quotations on behalf of any third party (including sub-agents or end customers), you will inform them fully of these Terms, supplier conditions, restrictions, and all applicable rules.
- You are financially responsible for all activity on your account, including use by your employees, sub-agents, or any person under your direction/control.
- All information you provide (including company details, GSTIN, PAN, bank details, and end-customer data) is true, accurate, current, and complete.
- No traveler in any booking facilitated through the Platform is an unaccompanied minor unless explicitly declared and approved in advance by us and the relevant supplier.
2. Agent Authorization and Role of TechTrail DMC Pvt Ltd
By registering on the Platform and accepting these Terms, each Agent irrevocably authorizes and appoints TechTrail DMC Pvt Ltd as its limited agent and representative solely for the purpose of:
- Facilitating access to supplier inventory and rates;
- Transmitting booking requests to suppliers;
- Coordinating confirmations, amendments, and cancellations as instructed;
- Processing payments (where applicable) and remitting funds to suppliers;
- Issuing booking confirmations, vouchers, and related documentation on behalf of the Agent.
TechTrail DMC Pvt Ltd acts exclusively as a B2B technology facilitator and intermediary platform. We do not act as a tour operator, principal seller, or provider of any bundled overseas tour programme package. The binding contract for travel services is formed directly between the Agent and the end customer (traveler). TechTrail DMC Pvt Ltd's role is strictly limited to providing the Platform infrastructure, aggregating supplier data, and executing instructions as per the Agent's requests.
3. Website/Platform and Pricing Accuracy
TechTrail DMC Pvt Ltd makes every reasonable commercial effort to ensure that all Information displayed on the Platform — including but not limited to pricing, availability, room types, meal plans, inclusions/exclusions, supplier descriptions, images, ratings, itineraries, flight schedules, transfer timings, and any other travel-related details — is accurate, up-to-date, and reliable at the time it is published.
However, the travel industry is dynamic, and the following factors may lead to discrepancies or errors:
- Real-time fluctuations in supplier inventory and pricing;
- Currency exchange rate variations;
- Human, system, or technical errors during data entry or synchronization;
- Changes implemented by airlines, hotels, ground operators, or other suppliers after content has been uploaded;
- Temporary promotional rates or flash sales that expire quickly;
- Miscommunication or delays in updating third-party supplier feeds.
3A. Agent's Verification Obligation:
It is the sole and absolute responsibility of the Agent to:
- Independently verify and confirm the final pricing, availability status, inclusions and exclusions, cancellation/amendment policies, special conditions, and all other material details directly with TechTrail DMC Pvt Ltd at the exact moment of requesting or confirming a quotation or booking;
- Cross-check all details against the most recent confirmation invoice/voucher issued by TechTrail DMC Pvt Ltd;
- Immediately notify TechTrail DMC Pvt Ltd in writing (via the Platform or support@techtraildmc.com) of any perceived discrepancy, error, or concern before proceeding with payment or presenting the quotation to the end customer.
Failure to perform such verification may result in the Agent bearing full financial responsibility for any consequences, including price adjustments, booking rejections, or additional costs.
3B. Price Correction Policy:
TechTrail DMC Pvt Ltd expressly reserves the right to correct any obvious or clerical errors in pricing, availability, or other details at any time, including:
- After a quotation has been issued;
- After a booking has been provisionally confirmed;
- After partial or full payment has been received.
In the event of such a correction:
- TechTrail DMC Pvt Ltd will notify the Agent promptly (usually via email and/or Platform notification);
- The Agent will be offered the corrected price and revised terms;
- If the Agent finds the corrected price or conditions unacceptable, the Agent may cancel the booking without any cancellation penalty from TechTrail DMC Pvt Ltd (however, any supplier-imposed cancellation charges or non-refundable deposits/fees will still apply as per the original supplier terms).
No compensation will be payable for inconvenience, lost opportunities, or any other consequential loss arising from such corrections.
4. Passports, Visas, Health Requirements, and Travel Documents
Compliance with all immigration, entry, health, and documentation requirements is exclusively the responsibility of the Agent and the end customer(s). TechTrail DMC Pvt Ltd does not provide legal advice, immigration consultancy, or guarantee entry into any country.
Agents must ensure that every traveler possesses:
- A passport valid for at least six (6) months beyond the intended date of return (or longer for certain destinations);
- All required visas, entry permits, e-Visas, visa-on-arrival eligibility, or electronic travel authorizations (e.g., ESTA for USA, ETA for Canada/Australia);
- Up-to-date vaccinations, health certificates, yellow fever certificates, PCR/antigen test results, or any other health documentation mandated by the destination country, transit countries, or airlines;
- Any additional documents such as return/onward tickets, proof of sufficient funds, hotel bookings, travel insurance certificates, or sponsor letters.
Important Notes
- Entry requirements, visa policies, health protocols, and quarantine rules change frequently and can be affected by geopolitical events, pandemics, or sudden government decisions.
- Agents must check the most current and official sources (e.g., embassy/consulate websites of the destination country, Indian Ministry of External Affairs, airline websites, and IATA Travel Centre) well in advance — ideally at quotation stage and again before final payment.
- Requirements may differ based on nationality, passport type, previous travel history, and even the purpose of visit.
TechTrail DMC Pvt Ltd's Limited Role
TechTrail DMC Pvt Ltd may, as a courtesy:
- Provide general, publicly available guidance on common requirements;
- Facilitate submission of visa applications through authorized third-party partners (where offered).
However, TechTrail DMC Pvt Ltd:
- Does not guarantee visa approval, processing time, or issuance;
- Accepts no responsibility or liability whatsoever for: (a) Visa refusals, delays, additional documentation requests, interview requirements, or rejections; (b) Denied boarding, denied entry at immigration, deportation, or quarantine; (c) Any financial loss, missed travel, or other consequences arising from incomplete, incorrect, or untimely documentation.
The Agent shall indemnify TechTrail DMC Pvt Ltd against any claims arising from visa/document-related issues affecting end customers.
5. Illustrative High-Risk Jurisdictions and Immigration Exposure (Non-Exhaustive and Without Limitation)
Without prejudice to the generality and absolute applicability of the Global Visa Compliance, Overstay & Immigration Liability Clause, the Agent expressly acknowledges and agrees that certain countries and regions maintain highly stringent immigration frameworks, zero-tolerance enforcement policies, and significant financial, legal, and operational consequences in the event of non-compliance by travelers.
Accordingly, the Agent accepts full responsibility and liability for all such risks, including but not limited to those arising in the following jurisdictions:
- United Arab Emirates: The UAE enforces strict immigration controls, including daily overstay fines, immediate penalties upon visa expiry, and potential detention, deportation, and administrative blacklisting. Additional liabilities may include outpass/exit permit charges, immigration clearance fees, and mandatory rebooking of outbound travel. In certain cases, sponsors or associated booking parties may also be held accountable.
- Saudi Arabia: Immigration violations may attract substantial monetary fines, imprisonment, deportation, and multi-year entry bans. Visa misuse (e.g., performing work on a tourist visa) is treated as a serious offense. Authorities maintain strict tracking and enforcement mechanisms.
- Qatar, Oman, and other GCC countries: Travelers may face overstay penalties, visa sponsorship complications, exit permit requirements (where applicable), detention, and deportation. Costs associated with compliance failures are often high and must be settled prior to exit.
- United Kingdom: Border authorities retain absolute discretion to deny entry even with a valid visa if documentation, intent of travel, financial proof, or travel history is deemed unsatisfactory. Immediate return/deportation costs must be borne by the traveler/Agent.
- United States: The USA follows a strict immigration enforcement regime. Overstay or visa violations may result in automatic bans ranging from 3 to 10 years, secondary inspections, detention, and deportation. Even minor discrepancies may lead to denial of entry.
- Schengen Area (including but not limited to France, Germany, Italy, Spain, etc.): The Schengen region operates as a single immigration zone, where violations in one country affect access to all member states. Overstay or misuse may result in fines, deportation, and long-term visa refusal across the entire region.
- Thailand, Indonesia, and similar Southeast Asian destinations: These countries impose daily overstay fines, and extended violations may lead to detention, deportation, and entry bans. Blacklisting periods may vary depending on the duration of overstay.
- Singapore: Singapore maintains zero-tolerance immigration policies, with violations potentially resulting in heavy fines, detention, deportation, and strict legal enforcement actions.
5A. Comprehensive Liability Acknowledgement
The Agent expressly agrees and undertakes that:
- The above list is purely illustrative, indicative, and non-exhaustive;
- Similar or more stringent immigration laws, penalties, and enforcement actions may apply in any country worldwide, regardless of whether specifically mentioned herein;
- Immigration authorities globally exercise absolute sovereign discretion, and decisions such as visa approval, denial of entry, detention, or deportation are final and binding.
The Agent shall be fully and solely responsible for:
- Ensuring that all travelers comply with visa validity, permitted duration of stay, and all entry/exit regulations;
- Advising travelers regarding risks, penalties, and legal consequences of non-compliance;
- Bearing all financial, legal, and operational consequences arising from any immigration-related issue.
5B. Indemnity and Cost Recovery
Without limitation, the Agent shall bear and indemnify TechTrail DMC Pvt Ltd against all costs and consequences, including but not limited to:
- Overstay fines, penalties, and immigration charges;
- Visa extensions, re-issuance, or status correction costs;
- Deportation, repatriation, and emergency travel arrangements;
- Airline penalties, no-show charges, and rebooking costs;
- Detention, legal proceedings, and administrative expenses;
- Any third-party claims, damages, or losses arising due to traveler non-compliance.
5C. Limitation of Role
TechTrail DMC Pvt Ltd acts solely as a technology facilitator and intermediary and has no control over immigration authorities, border control decisions, or traveler conduct. Accordingly, TechTrail DMC Pvt Ltd shall not be liable under any circumstances for:
- Denial of visa or entry;
- Overstay or visa violations;
- Deportation, detention, or blacklisting;
- Any direct or indirect losses arising from such events.
5D. Survival Clause
This provision shall survive the completion, cancellation, or termination of any booking or transaction and shall remain legally binding on the Agent at all times.
6. Travel Insurance
TechTrail DMC Pvt Ltd considers comprehensive travel insurance to be essential for all travelers and strongly recommends (and in some cases, suppliers may require) that every end customer purchases adequate coverage before commencing travel.
Recommended minimum coverage should include (but not be limited to):
- Emergency medical expenses and hospitalization (including COVID-19 related treatment where applicable);
- Trip cancellation, curtailment, interruption, or delay;
- Loss, theft, or damage to baggage, personal belongings, and travel documents;
- Personal accident, liability, and legal expenses;
- Emergency evacuation and repatriation;
- Coverage for pre-existing medical conditions (if declared and accepted by the insurer);
- Activities that may be considered adventurous or hazardous (if the itinerary includes such elements).
6A. Agent's Responsibility:
It is the Agent's duty to:
- Actively advise and encourage end customers to procure suitable insurance;
- Ensure the policy is in force for the entire duration of travel (including pre- and post-trip extensions where necessary);
- Verify that the coverage limits, exclusions, and conditions match the traveler's age, health status, destination risks, and itinerary specifics.
6B. TechTrail DMC Pvt Ltd's Position:
TechTrail DMC Pvt Ltd shall not be liable or responsible in any way for:
- Any loss, expense, liability, injury, illness, death, or claim that would have been (or could have been) covered under an adequate travel insurance policy;
- Denied entry, denied boarding, or other immigration/health authority actions due to lack of insurance proof;
- Any situation where the end customer is unable to claim from their insurer due to policy exclusions, late purchase, non-disclosure, or other reasons.
The Agent shall indemnify TechTrail DMC Pvt Ltd against any claims or demands arising from the absence or inadequacy of travel insurance for end customers.
7. Payments
A booking is considered confirmed only upon receipt of the required payment (deposit or full amount) as per the payment schedule indicated in the quotation, confirmation invoice, or Platform terms at the time of booking.
7A. Payment terms vary based on factors such as:
- Type of hotel (refundable vs. non-refundable/promotional rates)
- Flight ticket type (flexible vs. non-refundable)
- Real-time availability of tickets/rooms
- Destination, season, and supplier policies
- Balance is due at least 10 days prior to departure (or earlier if supplier deadlines require, e.g., ticket issuance or hotel guarantees).
7B. Accepted Payment Methods
TechTrail DMC Pvt Ltd accepts payments through:
- Major credit cards and debit cards (Visa, Mastercard, RuPay, etc.);
- Net banking / Internet banking;
- UPI;
- NEFT / RTGS / IMPS bank transfers (advance intimation required for large amounts);
- Other approved digital wallets or methods as displayed on the Platform.
Convenience / Service Fees: A convenience fee, transaction fee, or payment gateway charge may be applicable depending on the payment mode selected (typically 1–3% for card payments). These fees are non-refundable and are clearly indicated before final payment. Bank transfer / NEFT / RTGS may be exempt from such fees in certain cases.
All payments must be made in the currency specified in the invoice (usually INR). Any bank charges, currency conversion fees, or other transaction costs are borne by the Agent. By making payment, the Agent confirms acceptance of all booking terms, conditions, and policies outlined in the confirmation.
8. Tax Collected at Source (TCS) Compliance
TechTrail DMC Pvt Ltd operates solely as a B2B technology platform facilitating bookings of individual travel services and components (e.g., flights, accommodation, transfers, and sightseeing) sourced from third-party suppliers. We do not sell, offer, or facilitate any bundled "overseas tour programme package" as defined under Section 206C (1G) of the Income Tax Act, 1961 (as amended from time to time). All transactions through the Platform are component-based and do not constitute a single integrated overseas tour programme package that triggers TCS obligations on TechTrail DMC Pvt Ltd.
As per the latest amendments effective from April 2026, the TCS rate on overseas tour programme packages has been reduced to a flat 2% (with no threshold). The Agent is solely responsible for:
- Determining whether their final offering/invoice to the end customer qualifies as an overseas tour programme package (e.g., if the Agent bundles multiple components into a single package sale).
- Collecting, depositing, reporting, and complying with any applicable TCS obligations (currently at a flat rate of 2% as per the prevailing rules under Section 206C (1G)).
- Issuing compliant invoices, collecting applicable taxes (GST, TCS, etc.) from end customers, and fulfilling all tax compliance requirements.
The Agent hereby abides by all the relevant provisions of the Income Tax Act and agrees to collect TCS from customers as per applicable rate for remittance purposes. The Agent further confirms that they will deposit TCS so collected with the Government and will file statutory returns/statements within statutory time limits.
The Agent hereby further declares that all required details and documents would be made available to TechTrail DMC Pvt Ltd / bank / RBI / Income Tax department evidencing collection and payment of TCS whenever called for.
The Agent hereby indemnifies TechTrail DMC Pvt Ltd, its directors, officers, employees, affiliates, and suppliers against any claims, demands, penalties, interest, assessments, or liabilities (including legal costs) arising from the Agent's non-compliance with TCS or any other tax laws related to bookings, quotations, or end-customer transactions facilitated via the Platform.
By using the Platform, the Agent agrees not to represent, market, invoice, or describe any services accessed through TechTrail DMC Pvt Ltd as a "holiday package", "tour package", "vacation package", "overseas tour programme", or any similar term that could imply a bundled overseas tour programme package under applicable tax laws.
9. Changes and Cancellations by Agent
All requests for changes (including but not limited to date modifications, itinerary alterations, name changes, addition/removal of travelers, or upgrades/downgrades of services) or cancellations must be submitted in writing by the registered Agent through the Platform's designated channels (email to support@techtraildmc.com or via the agent dashboard where available). Verbal requests, phone calls, or messages through unofficial channels will not be accepted or processed.
Changes are strictly subject to availability from the relevant suppliers (airlines, hotels, ground operators, etc.) at the time of the request. TechTrail DMC Pvt Ltd will use reasonable endeavours to accommodate requested changes, but we cannot guarantee success, especially for time-sensitive or peak-season bookings.
9A. Any approved change may incur:
- Supplier-imposed amendment fees;
- Additional costs for re-booking or re-sourcing the service at prevailing rates;
- Administrative fees charged by TechTrail DMC Pvt Ltd;
- Full re-booking costs if the original service is non-transferable or non-amendable.
9B. Certain travel components are highly restrictive and treated as cancellations rather than amendments:
- Non-refundable airline tickets (including promotional or restricted fares);
- Promotional or special-rate hotel bookings;
- Pre-paid sightseeing tours, transfers, or visa-related services;
- Chartered transportation or exclusive experiences.
These may attract up to 100% cancellation charges (i.e., no refund possible), regardless of the timing of the request. Name changes are often considered full cancellations and re-bookings, attracting the same penalties.
9C. Cancellation Charges Scale:
Cancellation charges are calculated as a percentage of the total booking value (excluding taxes where non-refundable) and are based on the date TechTrail DMC Pvt Ltd receives the written notice (not the date sent or when the Agent decides). The exact scale will be provided in the booking confirmation/invoice or quotation at the time of booking, as it varies by supplier, destination, season, and component. Typical industry ranges (subject to specific confirmation) include:
- More than 60 days before departure: 10–25% (or deposit amount);
- 30–59 days before departure: 25–50%;
- 15–29 days before departure: 50–75%;
- 7–14 days before departure: 75–90%;
- Less than 7 days or no-show: 100%.
These are minimums; suppliers may impose higher charges (e.g., full forfeiture for non-refundable elements). TechTrail DMC Pvt Ltd's service fee or commission is non-refundable in all cases.
If only some members of a group/party cancel, the remaining travelers' costs will be recalculated based on the new party size. This may result in additional charges, such as single room supplements, higher per-person rates, or loss of group discounts. The Agent is responsible for collecting and settling any such surcharges from end customers.
9D. Amendment Fees:
All processing or amendment fees (whether from suppliers or TechTrail DMC Pvt Ltd) are non-refundable, even if the change is later cancelled or the booking is fully refunded. The Agent acknowledges that early cancellations minimize charges, and it is the Agent's responsibility to advise end customers accordingly. In cases where cancellation is due to reasons covered by travel insurance (e.g., illness, death), the Agent/end customer may claim from their insurer, but TechTrail DMC Pvt Ltd bears no responsibility for such claims.
10. Changes and Cancellations by TechTrail DMC Pvt Ltd/Suppliers
10A.
TechTrail DMC Pvt Ltd, acting as a facilitator, and/or the underlying suppliers (airlines, hotels, transport providers, etc.) reserve the absolute right to make changes to confirmed bookings, correct any errors in pricing/availability/descriptions, or cancel bookings at any time before or after confirmation. Such changes may occur due to:
- Supplier unavailability or operational issues;
- Force majeure events (including but not limited to natural disasters, severe weather, pandemics/epidemics, government restrictions, strikes, riots, war, terrorism, acts of God, quarantine, civil unrest, or any other event beyond reasonable control);
- Safety/security concerns;
- Overbooking by suppliers;
- Changes in laws, regulations, or official advisories.
10B. Changes are classified as:
- Minor changes — e.g., minor time adjustments, hotel room category swaps of similar standard, or small itinerary tweaks — which do not entitle the Agent to cancel without charges.
- Major changes — e.g., significant date/time shifts, change of destination, substantial reduction in services, or downgrade of accommodation/transport standard.
In the event of a major change or full cancellation by TechTrail DMC Pvt Ltd/suppliers, we will notify the Agent as soon as reasonably practicable (via email or Platform notification). The Agent will be offered, where possible:
- Acceptance of the revised arrangements;
- Alternative comparable arrangements of similar or higher standard (if available), with any price difference payable by the Agent (or refunded if lower);
- Full refund of amounts paid (subject to deductions for non-recoverable supplier charges).
No further compensation (e.g., for consequential losses, inconvenience, or additional expenses) will be payable. The Agent must inform end customers promptly and handle any related queries.
11. Refunds
All refunds (whether due to cancellation by Agent, TechTrail DMC Pvt Ltd/suppliers, or other reasons) are subject to the applicable supplier policies, non-recoverable charges, and deductions (e.g., cancellation fees, processing costs, bank charges). Refunds will be processed only after receipt of full documentation and verification.
Refunds are issued to the original mode of payment used by the Agent:
- Processing time: Typically 3–21 working days after initiation (longer if KYC, supplier approval, or additional verification is required);
- Credit/debit card refunds: To the original card (may take up to 45 days depending on card issuer);
- Bank transfers: To the registered Agent bank account (may require proof of ownership);
- PayPal: Refunds after 60 days from original transaction are issued only to the original linked PayPal email ID (quickest method); cross-currency refunds are not entertained.
The Agent is responsible for passing refunds (or adjustments) to end customers. TechTrail DMC Pvt Ltd is not liable for delays caused by banks, payment gateways, or suppliers. No interest is payable on refunds.
12. Flights and Supplier Services
All flight details (including carrier, flight numbers, timings, aircraft type, routing, and stops) displayed on the Platform or in confirmations are indicative only and subject to change without prior notice due to airline operational requirements, weather, air traffic control, or other factors.
The Agent must:
- Verify all ticket details (including timings, baggage allowances, and conditions) immediately upon receipt of e-tickets or confirmations;
- Check-in online or at the airport as per airline rules;
- Inform end customers of potential changes and the need for travel insurance covering flight disruptions.
TechTrail DMC Pvt Ltd shall not be liable for any consequences arising from flight changes, delays, cancellations, carrier substitutions, missed connections, denied boarding, or overbooking. The Agent's recourse lies directly with the airline/supplier under applicable passenger rights regulations (e.g., DGCA rules in India).
13. Conduct and Liability
The Agent assumes full responsibility for the behavior and conduct of all end customers (and their accompanying parties) throughout the travel period, including compliance with supplier rules, local laws, and public order.
If TechTrail DMC Pvt Ltd, any supplier, or authority reasonably determines that any end customer is behaving in a manner that:
- Endangers safety;
- Causes annoyance, distress, or damage to others/property;
- Breaches terms of carriage, hotel policies, or local regulations;
- Involves illegal activity, intoxication, or disruptive conduct,
Services may be terminated immediately for the offending individual(s) without refund, compensation, or further liability. The affected person(s) will be required to arrange alternative travel at their own expense.
The Agent shall indemnify and hold harmless TechTrail DMC Pvt Ltd against any claims, losses, damages, costs, fines, or expenses (including legal fees) arising from end-customer conduct, including property damage, personal injury, or third-party claims.
14. Complaints
Any issues, dissatisfaction, or problems with services must be reported immediately during the trip to:
- The local supplier representative (e.g., hotel manager, ground handler);
- TechTrail DMC Pvt Ltd support (via email or emergency contact provided in confirmations).
This allows for on-site resolution in most cases. Failure to report contemporaneously may prejudice any subsequent claim.
Post-travel, written complaints with full details (including booking reference, dates, evidence/photos, and desired resolution) must be submitted to support@techtraildmc.com within 7 days of return/completion of the last service. Late complaints may not be entertained. TechTrail DMC Pvt Ltd will investigate and respond within a reasonable timeframe, but liability is limited as per these Terms.
15. Limitation of Liability
TechTrail DMC Pvt Ltd provides the Platform with reasonable skill and care but shall not be liable for:
- Acts/omissions of Agents, end customers, suppliers, or third parties;
- Supplier defaults, failures, or changes;
- Indirect, consequential, special, punitive, or exemplary damages (including loss of profit, revenue, data, goodwill, business interruption);
- Force majeure events (natural disasters, pandemics/epidemics, strikes, war, government actions, network failures, etc.);
- Local excursions/activities booked independently.
To the maximum extent permitted by law, TechTrail DMC Pvt Ltd's total aggregate liability shall not exceed the commission/service fee received by TechTrail DMC Pvt Ltd for the relevant booking. The Agent indemnifies TechTrail DMC Pvt Ltd against all claims/losses arising from Platform use, bookings, end-customer disputes, or tax non-compliance.
16. Prohibited Activities
Agents agree to use the Platform only for legitimate business purposes in accordance with these Terms and all applicable laws. The following activities are strictly prohibited and constitute material breach of these Terms. Engaging in any of the below may result in immediate suspension or permanent termination of your account, forfeiture of any commissions or credits, blacklisting from the Platform, reporting to relevant authorities, and pursuit of all available legal remedies (including civil and criminal proceedings) at TechTrail DMC Pvt Ltd's sole discretion:
- Making any speculative, fictitious, false, or fraudulent bookings, including bookings made without a genuine end-customer intent, in anticipation of future demand, for resale at inflated prices, or using invalid/stolen payment methods.
- Accessing, monitoring, copying, or extracting any content, rates, availability data, supplier information, or other proprietary data from the Platform using robots, spiders, scrapers, automated scripts, data mining tools, or any other manual or automated process without our express prior written permission.
- Attempting to gain unauthorized access to the Platform, any associated accounts, computer systems, networks, or any part of the infrastructure through hacking, password mining, phishing, brute-force attacks, or any other illicit means.
- Misusing, reverse-engineering, decompiling, disassembling, or attempting to derive the source code of the Platform or any related software.
- Circumventing, disabling, or otherwise interfering with security-related features of the Platform, including robot exclusion headers, rate-limiting mechanisms, or access controls.
- Impersonating any person or entity, misrepresenting your affiliation with TechTrail DMC Pvt Ltd or any supplier, or forging headers or identifiers to disguise the origin of any communication or data transmitted through the Platform.
- Uploading, transmitting, or distributing any viruses, malware, worms, Trojan horses, corrupted files, or any other harmful code or content that may damage, interfere with, or disrupt the Platform or any user's equipment.
- Overloading, flooding, spamming, mail-bombing, or otherwise imposing an unreasonably large or disproportionate load on the Platform's infrastructure, servers, or bandwidth.
- Using the Platform to transmit unsolicited commercial communications, chain letters, junk mail, spam, or any other form of unauthorized solicitation.
- Collecting or harvesting any personally identifiable information about other Agents, end customers, or suppliers from the Platform without their explicit consent.
- Engaging in any activity that violates any applicable law, regulation, or third-party rights, including intellectual property rights, privacy rights, or anti-money laundering regulations.
- Using Platform rates, inventory, or content for any purpose other than legitimate booking facilitation for your end customers (e.g., publishing Platform-exclusive rates on public websites, third-party portals, or competing platforms without authorization).
- Any conduct that, in TechTrail DMC Pvt Ltd's reasonable opinion, damages, tarnishes, or negatively impacts the reputation, goodwill, brand, or business interests of TechTrail DMC Pvt Ltd, its suppliers, or the Platform.
TechTrail DMC Pvt Ltd reserves the right to investigate any suspected violation, cooperate with law enforcement, and take appropriate action without prior notice. Agents shall indemnify TechTrail DMC Pvt Ltd against any losses, claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to any prohibited activity.
17. Data Protection and Privacy
TechTrail DMC Pvt Ltd is committed to protecting personal data in compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act), the Information Technology Act, 2000 (as amended), the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and all other applicable Indian and international data protection laws.
All personal data collected through the Platform (including but not limited to Agent details, end-customer names, contact information, passport details, travel preferences, payment information, and special requirements) is processed solely for the purposes of facilitating bookings, communicating confirmations/vouchers, coordinating with suppliers, processing payments, handling customer support queries, and complying with legal obligations.
By registering and using the Platform, Agents expressly consent to:
- The collection, storage, processing, and transfer of personal data (including sensitive personal data such as health-related information for special requests) within India and to international destinations where suppliers are located, subject to adequate safeguards.
- Sharing of necessary personal data with third-party suppliers (hotels, airlines, ground handlers, visa processing partners, etc.), payment gateways, and other service providers strictly required for the execution of bookings.
- Use of personal data for internal business purposes, such as analytics to improve the Platform, fraud prevention, and sending transactional/service-related communications.
Agents represent and warrant that they have obtained all necessary consents, permissions, and authorizations from end customers to share their personal data with TechTrail DMC Pvt Ltd and suppliers as contemplated under these Terms. Agents shall comply with all data protection obligations when handling end-customer data, including implementing reasonable security measures and responding to data subject rights requests.
TechTrail DMC Pvt Ltd's detailed data handling practices are set out in our Privacy Policy (available on the Platform), which forms an integral part of these Terms. In case of any conflict, the provisions of the DPDP Act shall prevail.
TechTrail DMC Pvt Ltd shall not be liable for any unauthorized access, loss, misuse, or disclosure of personal data caused by the Agent, end customer, or any third party beyond TechTrail DMC Pvt Ltd's reasonable control.
18. Special Requests and Accessibility
Agents may submit special requests on behalf of end customers at the time of booking (e.g., wheelchair-accessible rooms, ground-floor accommodation, specific dietary requirements, early check-in/late check-out, bed configuration, non-smoking rooms, child-specific amenities, or medical/religious considerations). TechTrail DMC Pvt Ltd will use reasonable endeavours to forward such requests to the relevant suppliers and note them on the booking confirmation. However, special requests are not guaranteed and do not form part of the contractual obligation unless explicitly confirmed in writing by TechTrail DMC Pvt Ltd as "confirmed" or "guaranteed".
Many suppliers, especially in remote or budget accommodations, may have limited facilities for accessibility (e.g., no ramps, elevators, or adapted bathrooms). It is the Agent's responsibility to assess suitability for any traveler with mobility, health, or other special needs and to advise end customers accordingly before booking.
If TechTrail DMC Pvt Ltd reasonably determines that it cannot accommodate a disclosed special need or disability (based on supplier feedback), we reserve the right to decline or cancel the booking without liability, and any applicable cancellation charges will be as per supplier terms.
19. Governing Law and Jurisdiction
These Terms and Conditions, the use of the Platform, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
Any legal proceedings, actions, suits, or claims arising out of or relating to these Terms, the Platform, or any booking facilitated through it shall be subject to the exclusive jurisdiction of the competent courts located in Aligarh, Uttar Pradesh, India.
All claims, complaints, or demands against TechTrail DMC Pvt Ltd must be submitted in writing (via email to support@techtraildmc.com with clear reference to the booking/agent ID) and received by TechTrail DMC Pvt Ltd no later than sixty (60) days after the completion of the last travel service in the booking (or, in case of non-travel, within 60 days of the event giving rise to the claim). Any claim not submitted within this period shall be deemed irrevocably waived and time-barred.
20. General Provisions
Entire Agreement:
These Terms (together with the Privacy Policy, any booking-specific terms displayed at the time of confirmation, and any written agreements between TechTrail DMC Pvt Ltd and the Agent) constitute the entire agreement between the parties and supersede all prior understandings.
Amendments:
TechTrail DMC Pvt Ltd reserves the right to modify, update, or amend these Terms at any time. The updated version will be posted on the Platform with the "Last Updated" date. Continued access or use of the Platform after such changes constitutes acceptance of the revised Terms.
Severability:
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver:
No failure or delay by TechTrail DMC Pvt Ltd in exercising any right or remedy shall constitute a waiver thereof.
Assignment:
Agents may not assign or transfer any rights or obligations under these Terms without TechTrail DMC Pvt Ltd's prior written consent. TechTrail DMC Pvt Ltd may assign these Terms to any affiliate or successor in interest.
Force Majeure:
TechTrail DMC Pvt Ltd shall not be liable for any failure or delay in performance due to events beyond its reasonable control.
